clintonmoffat.co.uk End User License Agreement (EULA)

• The following is a legal agreement between you and clintonmoffat.co.uk By downloading any Image; you agree to be bound by the terms of this agreement.
• All Images are copyrighted. clintonmoffat.co.uk owns all rights to the images. All rights are reserved by clintonmoffat.co.uk unless otherwise granted to you.
• By this Agreement, clintonmoffat.co.uk grants you a personal, non-exclusive, non-transferable, right to use and reproduce images in the following ways:

1. On web sites, multimedia presentations, and broadcast film and video.
2. In magazines, newspapers, books, eBooks, pamphlets, brochures, catalogues, book covers, textbooks, editorials, toolbar skins, posters, mobile phones, greeting cards (paper or online), CD/DVD cover art, and advertising.
3. In connection with your business identity on letterhead, posters, brochures, or business cards.
4. As decoration in office, restaurant, public area, home, or store.
5. In coordination with opt-in email marketing. Images cannot be used in the body of unsolicited bulk email - or linked from unsolicited bulk email.
6. All other rights in the images are expressly reserved by clintonmoffat.co.uk

You may NOT:

1. Use or display any Image on websites designed to induce sales of "print on demand" products, including postcards, mugs, t-shirts, posters and other items.
2. Use an Image other than as specified in the preceding section.
3. Use an Image with pornographic, defamatory, or otherwise unlawful or immoral content or in such a manner that it infringes upon any third party's trademark or intellectual property.
4. Resell any Image.
5. Share an Image by providing access on shared disk drives or networks. 
6. Use clintonmoffat.co.uk images to compete with clintonmoffat.co.uk This includes, by way of illustration, not by way of limitation, displaying images in any format (including thumbnails) for download on a website.
7. Use any Image as part of a trademark or patent image.
8. Use any Image as part of a logo.
9. Produce printed reproductions of any Image on canvas or paper to be sold.  

• "Non-transferable" as used herein means that except as provided in this EULA, you may not sell, rent, load, give, sublicense, or otherwise transfer to anyone the Image or the right to use the image... In addition, the work you produce with the image must be used for your direct employer, client, or customer, who must be the end user of your work. You agree to take all commercially responsible steps to prevent third parties from duplicating any Image. This may include invisibly watermarking the image and identifying that clintonmoffat.co.uk owns the image on the document you intend to use the image.
• You agree that you will not share your username and password combination. If any two users on two separate computers are using the same username and password, we reserve the right to terminate that account without refund or prior notice. We reserve the right to monitor accounts and institute mechanical or other means to stop users from sharing their login information.
• You agree to indemnify and hold clintonmoffat.co.uk, its officers, employees, shareholders, directors and suppliers harmless against any damages or liability of any kind arising from any use of the image other than the uses expressly permitted by this Agreement.
• Neither clintonmoffat.co.uk or any of its directors, officers, employees, partners, licensors, or agents shall be liable for any damages, whether direct, indirect, consequential, or incidental, arising out of the use of, or the inability to use, any image or images.  
• Additional rights to images are available. If you are unsure of your rights under this agreement, or if you wish to use an image in a matter not expressly permitted under this agreement, please contact clintonmoffat.co.uk
• You must satisfy yourself that all necessary rights, consents or permissions as may be required for reproduction of any image have been secured by you.
